The rules in Indiana
- Small estate limit: $100,000 (Small estate affidavit (IC 29-1-8-1)). Does not cover real estate. Heirs wait 45 days after the death. Clark County Clerk of Courts affidavit form (in.gov): more than 45 days after death; gross probate estate, wherever located, less liens, encumbrances and reasonable funeral expenses, not over $100,000 (IC 29-1-8-1). The statute applies $100,000 to deaths after June 30, 2022 ($50,000 before).
