The rules in Oregon
- Small estate limit: $75,000 (Simple estate affidavit, ORS 114.505 to 114.560 (criteria ORS 114.510, filing ORS 114.515)). Can cover real estate. Heirs wait 30 days after the death. Personal property up to $75,000. Real property up to $200,000 can also pass by the same simple estate affidavit; both caps apply separately (ORS 114.510). Read in ORS 114.510 and 114.515 (2025 edition, Wayback Sept 2026). Two separate caps: personal property other than manufactured homes up to $75,000, and real property plus manufactured homes up to $200,000. 275,000 is the sum and applies only when both caps are met. Values are fair market value without deduction for liens. Filing allowed 30 days after death. Filing fee is the ORS 21.145 fee, $124 (read in ORS 21.145, 2025 edition); the $145 lead is not supported. Source
- Court fee: $591 for a $300,000 estate. Read in ORS 21.170(1), 2025 edition (Wayback May 2026), last amended 2019: petition to appoint a personal representative, estate less than $50,000 $278; $50,000 to under $1 million $591; $1 million to under $10 million $882; $10 million or more $1,176. ORS 21.170(2) also charges a fee for each annual or final accounting ($35 / $298 / $591 / $1,176 by the same bands). Not included, because ORS 116.083 allows a statement in lieu of the final account and I did not confirm that the fee always applies. Source
- Attorney fee: No legal schedule: set by agreement or the court. Read in ORS 116.183: the personal representative is allowed reasonable fees of attorneys and other professionals. No schedule. Source
- Executor fee: Set by state law. Read in ORS 116.173(3) (2025 edition): 7% of the first $1,000, 4% to $10,000, 3% to $50,000, 2% above $50,000. Plus 1% of property outside the court's jurisdiction that is reportable for Oregon or federal estate tax, excluding life insurance. Not increased for multiple representatives. Court may add for extraordinary services, or set a different amount under ORS 113.038. Source
